TERMS AND CONDITIONS OF SEASON PARKING SURIA SABAH SHOPPING MALL CAR PARK
1. General
1.1 The License Plate Recognition (LPR) System is implemented to facilitate automated vehicle entry and exit based on registered vehicle plate numbers.
1.2 Use of the LPR system is subject to these Terms and Conditions.
2. Eligibility & Registration
2.1 Only vehicles with properly registered and approved vehicle plate numbers are eligible for seamless access via the LPR system.
2.2 The season pass user is responsible for ensuring that all vehicle plate details provided are accurate, complete, and up to date.
2.3 Makamewah Sdn. Bhd. shall not be held responsible for access issues arising from incorrect, incomplete, or outdated vehicle plate information.
3. System Operation
3.1 Entry and exit are granted based on successful recognition of the registered vehicle plate number.
3.2 If the LPR system fails to recognize a registered vehicle plate number, the season pass usermay be required to use alternative access methods as determined by the Makamewah Sdn.Bhd.
3.3 Makamewah Sdn. Bhd. reserves the right to temporarily suspend the LPR system for maintenance, system upgrades, or technical issues without prior notice.
4. Charges & Fees
4.1 Vehicles not recognized by the LPR system may be subject to prevailing daily charges.
4.2 Any parking charges incurred due to failure in plate recognition shall be borne by the Season pass user.
4.3 Refunds arising from LPR recognition issues shall be at the sole discretion of the Makamewah Sdn Bhd.
5. Compliance
5.1 The season pass user, its servants, agents, and invitees shall comply with all rules and regulations governing the use of the car park and LPR system.
5.2 Any misuse, manipulation, or attempt to bypass the LPR system is strictly prohibited.
6. New Application
6.1 A processing fee of RM30.00 per Season Parking shall be paid upon registration.
6.2 The processing fee is strictly non-refundable in the event the season pass user decides not to proceed or use the Season Parking facility.
7. Price of Season Parking
7.1 The published monthly Season Parking fee is RM170.00 (Ringgit Malaysia One Hundred and Seventy Only) per month.
7.2 Renewal for Season Parking must be completed before the month starts to avoid interruption of car park access.
7.3 The season pass will only be activated after the season parking fees and/or processing fee is paid. Whichever car entered without an active season pass is subject to prevailing daily rate.
8. Inactive Season Parking
8.1 Season Parking that remains inactive for a period of three (3) consecutive months shall be cancelled by the Makamewah Sdn Bhd.
8.2 Should the season pass user wish to reactivate the Season Parking after cancellation, a processing fee of RM30.00 shall be imposed.
9. Liability and Indemnity
9.1 All vehicles entering or parked within the car park premises shall be entirely at the owner’s sole risk.
9.2 Makamewah Sdn. Bhd. shall not be liable for any loss, theft, damage, or accident involving any vehicle, its accessories, or any personal belongings left within the vehicle, howsoever caused.
9.3 Makamewah Sdn. Bhd. shall not be responsible for any injury, loss, or damage sustained by the season pass user, its servants, agents, invitees, or any third party while within the car park premises.
10. Usage of LPR System
10.1 LPR access is strictly assigned to registered vehicle plate numbers and is non-transferable.
10.2 Any unauthorized use, sharing, duplication, or misuse of registered vehicle plate numbers may result in suspension or termination of Season Parking privileges without refund.
10.3 If the LPR system fails to recognize the registered vehicle plate number, the season pass user shall follow alternative verification or payment procedures as determined by Makamewah Sdn. Bhd.
10.4 Any vehicle that is not registered under the LPR system shall be treated as a normal parking vehicle and will be charged prevailing parking rates.
10.5 The season pass user is responsible for informing the Makamewah Sdn. Bhd. and updating the system in the event of any change of vehicle or vehicle plate number.
11. Amendment of Registered Vehicle Details
11.1 The season pass user shall notify Makamewah Sdn. Bhd. of any changes to the registered vehicle plate number or vehicle details at least fourteen (14) working days in advance. Makamewah Sdn. Bhd. reserves the absolute right to approve or reject such requests and may impose administrative or processing charges for multiple amendments to the registered vehicle details.
12. Barrier & Equipment Protection
12.1 The season pass user shall ensure vehicles stop safely and comply with barrier instructions.
12.2 Any damage caused to barriers, cameras, or LPR equipment due to negligence shall be borne by the vehicle owner or season pass user.
13. Tailgating
13.1 Tailgating (any vehicle following another vehicle through the entrance or exit barrier without proper authorization or individual system validation) is strictly prohibited.
13.2 Any vehicle found engaging in tailgating may be subject to penalties, suspension or termination of LPR privileges, and/or additional parking charges as determined by the Makamewah Sdn. Bhd.
14. Rights of Makamewah Sdn. Bhd.
14.1 Makamewah Sdn. Bhd. reserves the right to suspend, deactivate, or terminate LPR access for any season pass user found to be in breach of any of these Terms and Conditions without prior notice. Any Season Parking fees paid shall be strictly non-refundable.
14.2 Makamewah Sdn. Bhd. reserves the right to revise, upgrade, suspend, discontinue, or otherwise modify the LPR system or any part thereof at any time for maintenance, operational requirements, or technical reasons without prior notice.
14.3 Makamewah Sdn. Bhd. reserves the right to revise or increase the Season Parking fees at any time during the validity period of the Season Parking.
14.4 Makamewah Sdn. Bhd. reserves the right to alter, amend, vary, or revise any of these Terms and Conditions relating to the LPR system at its sole discretion without prior notice. All decisions made by Makamewah Sdn. Bhd. shall be final and binding on the season pass user.
